These terms are a contract between you and us. Please read them. If you do not agree with them, do not use the service.
ThaiCards is operated by ALEX SEARS, CPA, LLC, a Texas limited liability company. You can reach us at [email protected]. In these terms, "we", "us" and "our" mean that company, and "you" means the person using the service.
ThaiCards is a language-learning tool. It provides spaced-repetition flashcards, a vocabulary explorer, pronunciation audio, tone and syllable practice, an AI conversation tutor, and LyricLens, which helps you study Thai using song lyrics. We may add, change, or remove features at any time.
The service is an educational aid. It is not a certified course, it does not lead to any qualification, and it is not a substitute for a qualified teacher.

We may suspend or end access that breaks these rules, and we can do so without notice where the breach is serious.
Custom vocabulary, saved words, notes, and anything else you add stay yours. You give us only the permission we need to run the service for you: to store your content, process it, and show it back to you across your devices. We do not claim ownership of it and we do not use it to train AI models.
The software, design, curated lesson content, and the arrangement of the vocabulary database are ours or our licensors', and are protected by copyright and other laws. Your subscription buys access to the service, not ownership of any part of it. Individual Thai words and their ordinary dictionary meanings are facts and are not claimed by anyone.
LyricLens works with song lyrics, which are usually protected by copyright owned by writers and publishers. Lyrics displayed or processed through the service are shown for the purpose of private study and commentary. We do not claim any rights in them, and providing them for study does not transfer any rights to you. Do not use the service to reproduce or distribute lyrics outside your own personal study.
LyricLens starts from the caption track the video platform already publishes for a video. Those captions are machine transcriptions and are frequently wrong, so we run them through our own correction, re-segmentation, romanization and translation before you see them. What we store is that processed output, which is our own work product. We do not publish a browsable library of song lyrics.
Some content in the service is retrieved from third-party sources or submitted by users. We do not review all of it in advance and we cannot guarantee it is accurate or authorized.
If you own rights in material on the service and believe it is being used without authorization, email [email protected] with enough detail to identify the work and where it appears, plus your contact details and a statement that you are the rights holder or authorized to act for them. We will remove or disable access to properly identified material promptly, and we will terminate the accounts of repeat infringers.
Parts of the service are produced by automated systems and language models. That includes translations, romanization, example sentences, tone analysis, pronunciation audio, and everything the AI tutor says. This output can be inaccurate, incomplete, or unnatural, and Thai is a language where a small error changes the meaning. Treat it as study material to be checked, not as authoritative instruction, and do not rely on it for anything consequential such as medical, legal, financial, or safety-critical communication.
We work to keep the service running and accurate, but we cannot promise it will be uninterrupted, error free, secure, or available in any particular place. To the fullest extent permitted by law, the service is provided "as is" and "as available", and we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
Some jurisdictions do not allow certain warranties to be excluded. Where that is the case, the exclusions above apply to you only as far as the law allows, and nothing in these terms removes rights you have as a consumer that cannot be waived.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to your use of the service, even if we have been advised that such damages are possible.
Our total liability for all claims relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim arose, or twenty US dollars.
Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.
If your use of the service, your content, or your breach of these terms leads to a claim against us by someone else, you agree to defend us and cover the resulting costs, damages, and reasonable legal fees, except to the extent the claim results from our own wrongdoing.
You can stop using the service at any time and delete your account. We can suspend or end your access if you break these terms, if we are required to by law, or if we discontinue the service. If we discontinue the service while you have paid time remaining, we will refund the unused portion. The sections on our content, disclaimers, limitation of liability, indemnity, and governing law survive the end of these terms.
We may update these terms. If a change materially affects your rights, we will give reasonable notice before it takes effect, through the app or by email. Continuing to use the service after that means you accept the updated terms. The date at the top shows when these terms last changed.
These terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws rules. Disputes will be brought in the state or federal courts located in Texas, and you and we consent to their jurisdiction. If you are a consumer living outside the United States, this does not deprive you of the protection of mandatory consumer law where you live, or of your right to bring proceedings there.

If any part of these terms is found unenforceable, the rest stays in force. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the whole agreement between you and us about the service. You may not transfer your rights under these terms without our consent, and we may transfer ours in connection with a merger, acquisition, or sale of assets.
